1. Description of Service
RentalRelay provides a web-based platform that helps landlords and property managers manage tenant communication via SMS. The service includes AI-assisted response routing, conversation documentation, escalation workflows, vendor coordination tools, and a management dashboard.
2. Eligibility & Account Responsibilities
You must be at least 18 years old and operate as a landlord, property manager, or authorized agent of a property management organization to use RentalRelay. You are responsible for:
- Maintaining the confidentiality of your login credentials
- All activity that occurs under your account
- Ensuring your team members comply with these Terms
- Providing accurate account and billing information
3. Acceptable Use
You agree to use RentalRelay only for lawful property management communication. You may not:
- Send unsolicited, harassing, or unlawful messages to tenants
- Use the platform to discriminate in housing in violation of Fair Housing laws
- Attempt to reverse-engineer, scrape, or compromise the platform
- Share your account with unauthorized parties
- Use RentalRelay to facilitate fraud or misrepresentation
4. SMS Compliance
You are solely responsible for complying with the Telephone Consumer Protection Act (TCPA), CAN-SPAM Act, state telemarketing laws, and CTIA messaging guidelines. This includes obtaining valid written consent from tenants before initiating automated SMS communication through RentalRelay.
RentalRelay provides STOP/HELP handling infrastructure, but you are responsible for initial consent collection (e.g., through your lease agreements or a separate opt-in process).
5. AI-Assisted Features
RentalRelay uses AI to analyze messages, generate draft responses, and classify requests. You acknowledge:
- AI responses may not always be accurate or appropriate
- You are responsible for reviewing and approving AI-generated communications
- The AI assists your workflow—it does not replace your legal obligations as a landlord
- RentalRelay is not liable for AI errors that you review and approve for sending
6. Subscriptions & Billing
- Subscriptions are billed monthly or annually in advance
- Prices are listed on our pricing page and may change with 30 days' notice
- Cancellations take effect at the end of the current billing period
- We do not offer refunds for partial billing periods
- Past-due accounts may be suspended after a 7-day grace period
7. Data Ownership
You retain ownership of all data you submit to RentalRelay, including property information, tenant records, and conversation history. You grant RentalRelay a limited license to process this data solely to provide the service.
RentalRelay retains ownership of its platform, AI models, codebase, and all platform-generated analytics.
8. Limitation of Liability
To the maximum extent permitted by law, RentalRelay is not liable for: (a) AI errors you approve for sending; (b) landlord-tenant disputes; (c) SMS delivery failures; (d) loss of data due to your actions; (e) any indirect, consequential, or punitive damages.
Our aggregate liability for any claim is limited to the fees you paid in the three months preceding the claim.
9. Termination
You may cancel your account at any time from your billing settings. We may suspend or terminate accounts that violate these Terms, with or without notice depending on severity. Upon termination, your data is retained for 90 days before deletion.
10. Governing Law
These Terms are governed by the laws of the state in which RentalRelay is incorporated. Disputes shall be resolved through binding arbitration under AAA rules, except for claims eligible for small claims court.
11. Changes to Terms
We may update these Terms. We will notify you by email 14 days before material changes take effect. Continued use after the effective date constitutes acceptance.
